Towing vehicles parked on private property
Virtually all managed communities have designated parking areas. Unauthorized or improperly parked vehicles may be towed under limited circumstances. Do you know them?
Chapter 715, F.S. has a section dealing with towing vehicles parked on private property. The owner or lessee of real property or any person they authorize, which may be the condominium association manager,
may cause any vehicle parked on the property without permission to be removed by a towing company without liability for the costs of removal, transportation or storage or damages caused by the removal, transportation or storage.
The governing documents of your Association may clarify which and what types of vehicles may be parked on common elements or limited common elements, thereby indicating how and when permission to park has been given. Many
Associations direct the management company to register owner and resident vehicles and to issue parking passes, decals or assigned parking spaces to aid in further identification of properly permitted vehicles.
If so instructed by the Board, Flagler Coastal Community Management will arrange towing of improperly parked or abandoned vehicles so long as the community has met the signage requirements of the Property Statute.
When entering into a contract for the Association with a properly licensed and insured towing company (and before any vehicles are actually towed) our CAM will verify that a sign containing the required notices
in at least 2" high light reflective letters on a contrasting background including the words "tow-away zone" in not less than 4" high letters as well as the name and telephone number of the towing company
has been permanently installed at any required property locations at a height of not less than 3' nor more than 6' above ground for at least the preceeding 24 hours.
